STATE INCOME TAX REBATE FROM THE COMMONWEALTH OF VIRGINIA
The following information was provided by the Commissioner of the Revenue’s Office regarding the Individual Income Tax Rebate from the Virginia Department of Taxation:
“Item § 3-5.28 2-23 INDIVIDUAL INCOME TAX REBATE of the 2023 Special Session I Amendments to the 2023 Appropriation Act (House Bill 6001, Special Session I, Chapter 1) allows an individual income tax rebate of up to $200 for a single taxpayer, or up to $400 for married taxpayers filing a joint return. In order to qualify, a Taxable Year 2022 return must be filed on or before November 1, 2023. A refund is allowed only up to the amount of the taxpayer’s tax liability after the application of any deductions, subtractions, or credits to which the taxpayer is entitled. For those filing a return before July 1, 2023, refunds that are determined to be due to eligible taxpayers must be issued on or before November 30, 2023. This Act also requires that any refunds issued are subject to collection under the Setoff Debt Collection Act and that no interest will be paid on any refund issued under this Act.”
“This Act also establishes a special nonreverting fund known as the “2023 Individual Income Tax Rebate Fund” and directs the State Comptroller to transfer an estimated $906,800,000 to it from the General Fund to issue the 2023 individual income tax rebate. The Governor, in consultation with the State Comptroller and the Tax Commissioner, are required to certify to the General Assembly on or before December 1 any additional transfer amounts to the 2023 Individual Income Tax Rebate Fund necessary to issue rebates.”
